Sau khi sinh con bao nhiêu thời gian thì tôi có thể được nhận tiền BHXH ?

Tôi đang công tác tại Công ty có vốn đầu tư nước ngoài. Hàng tháng Cty  chúng tôi thực hiện đầy đủ việc đóng BHXH. Mọi chế độ đều theo chế độ của VN, Nay tôi đã sinh con thứ 2 ngày 10 tháng 5 năm 2008 đến hôm nay đã  được 4 tháng 17 ngày nhưng vẫn chưa được nhận tiền trợ cấp bảo hiểm xã hội. Tôi đã hỏi nhân sự của công ty thì được biết Công ty đã nộp đầy đủ hồ sơ trước ngày 20 tháng 6 năm 2008 mà đến thời điểm bây giờ vẫn chưa được duyệt. Tôi muốn hỏi theo luật thì sau đẻ bao nhiêu thời gian thì tôi có thể  được nhận tiền BHXH. Khi Công ty chậm nộp tiền BHXH thì bị phạt. Vậy khi cơ quan bảo hiểm chậm giải quyết chế độ th ì có bị xử lý không? Tôi rất mong sớm nhận được sự trả lời. Tôi xin chân thành cảm ơn!
